Terms of Service

These Terms of Service ("Terms") govern your use of SafiriPro, a software platform provided by Peskaya Limited, a company registered in Kenya ("SafiriPro", "we", "us"). By creating an account or using SafiriPro, you agree to these Terms. If you're accepting on behalf of a company, you confirm you have authority to bind that company.

1. The service

SafiriPro is a web-based platform that helps safari and travel operators manage clients, build trip proposals, maintain a supplier inventory, and track bookings. We offer the service on a subscription basis, with plans described on our pricing page.

2. Your account

• You must provide accurate information when creating an account and keep it current.
• You're responsible for keeping your password secure and for all activity under your account.
• You must be at least 18 years old and legally capable of entering a contract.
• Notify us promptly at security@safiripro.com if you suspect unauthorized access.

3. Free trial

New accounts get a 14-day free trial of a paid plan. No payment is required to start. If you don't subscribe by the end of the trial, your account moves to a limited read-only state so you don't lose data. You can subscribe or export your data at any time.

4. Subscriptions, billing, and refunds

• Subscriptions renew automatically at the end of each billing cycle (monthly or annual) until cancelled.
• Payments are processed in KES via Paystack. Prices are exclusive of applicable taxes unless stated otherwise.
• You can cancel anytime from your account settings. Cancellation stops future renewals; it does not refund the current period.
• We do not offer prorated refunds for partial months. If we materially break something we promised and can't fix it in a reasonable time, email hello@safiripro.com and we'll make it right.
• If a payment fails, we'll retry and notify you. Persistent non-payment will suspend the account and, after 30 days, lead to deletion of data subject to our Privacy Policy.

5. Plan limits and AI credits

Each plan includes limits on team members, quotes, inventory items, and monthly AI credits. Exceeding a limit may require upgrading or waiting for your next billing cycle. Unused AI credits do not roll over month to month. AI credits are an internal metering unit with no cash value and cannot be refunded.

6. Your content

You retain all rights to the content you upload — client contacts, supplier data, itineraries, branding, and images ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to provide the service to you and the people you authorize.

You are responsible for ensuring you have the right to upload Your Content — including consent from your clients for the personal information you enter — and that it does not infringe any third-party rights or violate applicable laws.

7. Acceptable use

You agree not to:

• Use SafiriPro for anything illegal, deceptive, or fraudulent.
• Send spam, phishing, or unsolicited marketing through our messaging features.
• Reverse-engineer the platform, scrape it at scale, or resell access without our written permission.
• Upload malware, or content that is defamatory, obscene, or violates third-party rights.
• Interfere with or disrupt the service, our infrastructure, or other users.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

8. Third-party services

SafiriPro integrates with services like Paystack, WhatsApp Business, email providers, and AI providers. Your use of those integrations is also subject to their terms. We're not responsible for third-party services, though we pick them carefully and work around their limitations where we can.

9. Intellectual property

SafiriPro and all related software, designs, and trademarks are the property of Peskaya Limited. These Terms don't grant you any rights to our trademarks or branding beyond the limited use necessary to use the service.

10. Service availability

We aim for high availability but don't guarantee uninterrupted service. We perform maintenance, ship updates, and occasionally have incidents. On paid plans we target 99.5% monthly uptime excluding scheduled maintenance. We'll communicate status and any significant downtime.

11. Disclaimers

SafiriPro is provided "as is" and "as available". To the maximum extent allowed by law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, uninterrupted, or meet every requirement you have.

12. Limitation of liability

To the maximum extent permitted by law, SafiriPro's total liability to you for any claim arising out of or relating to these Terms or the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data.

13. Termination

You can stop using SafiriPro and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, don't pay, or if we're required to by law. On termination, your right to use the service ends immediately; the data-retention rules in our Privacy Policy apply.

14. Changes to these Terms

We may update these Terms from time to time. If the changes are material, we'll give notice by email or in-app before they take effect. Continuing to use SafiriPro after the changes take effect means you accept the new Terms.

15. Governing law and disputes

These Terms are governed by the laws of Kenya. Any dispute will be resolved in the courts of Nairobi, Kenya, unless we agree otherwise. Nothing in this section limits your non-waivable rights under mandatory consumer protection law.
